Terms of Use (End User License Agreement)

Welcome to Powder! These Terms of Use ("Terms") govern your use of the Powder mobile application ("App") and any subscription services provided through the App. By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the App.
1. Subscription Terms and Conditions
Powder offers premium subscription services that provide access to advanced features. By subscribing, you agree to the terms outlined below.
1.1 Powder Pro Yearly Subscription
- Product Name: Powder Pro Yearly
- Price: $29.99 per year (or equivalent in local currency)
- Duration: 1 year
- Subscription Type: Auto-renewable subscription
- Free Trial: 7-day free trial for new subscribers
- What's Included: Unlimited ski sessions, advanced analytics, full resort database, premium features, and all future updates
1.2 Powder Pro Weekly Subscription
- Product Name: Powder Pro Weekly
- Price: $5.99 per 7 days (or equivalent in local currency)
- Duration: 7 days
- Subscription Type: Non-renewing subscription (one-time purchase)
- Note: This is NOT auto-renewable. Users must manually repurchase after the 7-day period expires.
2. Auto-Renewal Information
⚠️ IMPORTANT: Auto-Renewal Terms for Powder Pro Yearly Subscription
By subscribing to Powder Pro Yearly, you agree to an automatically renewing subscription. Your subscription will automatically renew for successive 1-year periods unless you cancel at least 24 hours before the end of the current subscription period.
Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You will be charged $29.99 (or the equivalent in your local currency) to your Apple ID account within 24 hours prior to the end of the current subscription period.
To cancel your subscription, go to your Apple ID account settings and manage your subscriptions. You can cancel anytime, and you will continue to have access to Powder Pro features until the end of your current subscription period.
No Refund for Current Period: Cancelling does not provide a refund for the current subscription period. You will retain access until the end of the billing period for which you have already paid.
3. Free Trial Information
New subscribers to Powder Pro Yearly are eligible for a 7-day free trial period.
- Trial Duration: 7 days from the date of subscription
- When Charged: Users will be charged $29.99/year after the 7-day free trial ends
- Trial Eligibility: Free trial is available to new subscribers only. If you have previously subscribed to Powder Pro Yearly, you are not eligible for the free trial.
- Trial Cancellation: Users can cancel during the free trial period to avoid being charged. To cancel, follow the cancellation instructions in Section 4 below.
- Auto-Renewal During Trial: The subscription will automatically convert to a paid subscription at the end of the free trial unless you cancel at least 24 hours before the trial period ends. You will be charged $29.99/year after the free trial expires.
4. Cancellation Policy
You may cancel your Powder Pro Yearly subscription at any time. Cancellation will take effect at the end of your current billing period.
4.1 How to Cancel Your Subscription
To cancel your Powder Pro Yearly subscription, follow these steps:
- Open the Settings app on your iPhone or iPad
- Tap on your Apple ID name at the top
- Tap "Subscriptions"
- Find "Powder Pro Yearly" in your list of active subscriptions
- Tap "Cancel Subscription"
- Confirm the cancellation
4.2 When Cancellation Takes Effect
- Cancellation takes effect at the end of the current billing period
- Users retain access to all Powder Pro features until the subscription period expires
- You will not be charged for any future renewal periods after cancellation
4.3 No Immediate Cancellation
You cannot cancel and receive an immediate refund during an active subscription period. Once a subscription period has begun, you have access to the service for the full duration of that period, even if you cancel before the period ends.
5. Refund Policy
All subscription purchases are processed through Apple's App Store. Refunds are handled by Apple, not directly by Powder.
5.1 How to Request a Refund
To request a refund for a subscription purchase, you must contact Apple directly through one of the following methods:
- Report a Problem: Visit https://reportaproblem.apple.com and sign in with your Apple ID to report the issue
- Apple Support: Contact Apple Support directly through their website or by phone
5.2 Refund Eligibility
- Apple determines refund eligibility on a case-by-case basis
- Refunds are typically not available for completed subscription periods
- Refund decisions are made solely by Apple, and Powder has no control over Apple's refund process
- We cannot promise refunds that Apple does not provide
6. Billing Information
- Payment Method: All payments are charged to your Apple ID account
- Billing: Payment is processed by Apple, not directly by Powder. We do not store or have access to your payment information
- Price Changes: If subscription prices increase, users will be notified at least 30 days in advance. You will have the opportunity to cancel before the price change takes effect
- Currency: Prices are displayed in local currency based on your location and Apple's pricing matrix
- Taxes: Applicable taxes may be added to subscription prices based on your location
7. Subscription Duration and Expiration
7.1 Yearly Subscription
- Active Period: 1 year from the purchase date (or after the free trial ends, if applicable)
- Renewal Date: Subscription renews automatically on the same date each year
- Expiration: Access ends if the subscription is cancelled and the current period expires
- Renewal Notification: Apple will notify you before each renewal
7.2 Weekly Subscription (Non-Renewing)
- Active Period: 7 days from the purchase date
- Expiration: Access ends automatically after 7 days
- No Auto-Renewal: This subscription does not automatically renew. Users must manually purchase again to continue access
- No Refund: Once purchased, the 7-day period cannot be refunded or extended

9. User Responsibilities
By using the App and subscribing to Powder Pro, you agree to the following responsibilities:
- Account Responsibility: You are responsible for maintaining the security of your account and Apple ID. You must not share your account credentials with others
- Payment Responsibility: You are responsible for ensuring your payment method (Apple ID) is valid and has sufficient funds. You are responsible for all charges incurred through your account
- Use of Service: You agree to use the App and subscription service in accordance with these Terms and applicable laws. You must not use the service for any illegal or unauthorized purpose
- Age Requirements: You must be of legal age to enter into a subscription agreement in your jurisdiction (typically 18 years or older, or the age of majority in your location). If you are under the age of majority, you must have parental or guardian consent
- Accurate Information: You agree to provide accurate and complete information when creating an account or subscribing
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Service Availability: The App and subscription service are provided "as is" and "as available" without warranties of any kind, either express or implied
- Data Loss: We are not responsible for any loss, corruption, or deletion of your data, including ski session data, statistics, or account information
- Third-Party Services: We are not responsible for the availability, accuracy, or reliability of third-party services, including but not limited to Apple's App Store, Firebase, or other service providers
- Maximum Liability: Our total liability to you for any claims arising from or related to the App or subscription service shall not exceed the amount you paid for the subscription in the 12 months preceding the claim
- No Consequential Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page.
- Right to Modify: We may update these Terms from time to time to reflect changes in our services, legal requirements, or for other reasons
- Notification: We will notify users of significant changes to these Terms through the App or via email. Material changes will be communicated at least 30 days in advance when possible
- Continued Use: Your continued use of the App and subscription service after changes are posted constitutes your acceptance of the updated Terms
- Disagreement: If you do not agree to the updated Terms, you must cancel your subscription and stop using the App
12. Family Sharing Information
Family Sharing: NOT AVAILABLE
Powder Pro subscriptions are NOT available through Apple's Family Sharing program. Each subscription is tied to a single Apple ID and cannot be shared with family members through Family Sharing.
If multiple family members wish to use Powder Pro, each person must purchase their own subscription using their individual Apple ID.
13. Acceptance of Terms
By downloading, installing, accessing, or using the Powder App, or by subscribing to Powder Pro, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
If you do not agree to these Terms, you must not use the App or subscribe to Powder Pro services.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Powder regarding the use of the App and subscription services, and supersede all prior agreements and understandings.
